Nadine Lustre willing to settle dispute with Viva out of court

Bukas umano ang aktres na si Nadine Lustre, 28, na maayos sa labas ng korte ang sigalot sa pagitan niya at ng Viva Artist Agency (VAA).

Ang VAA ang siyang namamahala sa showbiz career ni Nadine mula pa noong 2004.

Sa Twitter ngayong araw, November 3, kinumpirma ng mga abugado ni Nadine na sina Atty. Gideon Peña at Atty. Eirene Jhone E. Aguila na kasalukuyang nakikipag-usap ang kanilang kampo sa management company ng aktres upang tapusin na ang sigalot sa pagitan ng magkabilang kampo.

Ayon sa inilabas na pahayag ng mga abugado ni Nadine, bagamat kampante ang aktres sa lakas ng kanyang ipinaglalaban, nananatili siyang bukas upang makipag-ayos sa Viva sa mga terminong “fair and mutually beneficial” para sa magkabilang kampo.

Nakasaad sa pahayag: “We confirm that there are ongoing negotiations to put an end to legal controversies between Nadine Lustre and Viva Artists Agency (“Viva”).

“While Nadine is confident about the strength of her legal position, she remains open to amicably settling with Viva and proceeding under terms that are fair and mutually beneficial.

“Like Viva, Nadine looks forward to continuing to provide quality entertainment to audiences both local and across the globe.

“Nadine trusts that Viva will remain true to its mission statement to empower and develop artists and their talents for the betterment of their careers and lives.”

THE LEGAL DISPUTE

Nagsimulang sumikat si Nadine sa showbiz dahil sa pelikulang Diary ng Panget, na pinagtambalan nila ni James Reid at iprinodyus ng Viva Films, noong taong 2014.

Kumalas siya bilang exclusive contract artist ng Viva Artists Agency noong January 2020.

Ayon sa pahayag ng abugado noon ni Nadine na si Atty. Lorna Kapunan: “For the information of the public, Nadine Lustre is no longer a talent of Viva Artists Agency.

“Consistent with her rights under the Civil Code of The Philippines, specifically Article 1920, she has decided to terminate her agency contract with Viva.

“As of now, Nadine is self-managed and will continue to be so indefinitely.

“She shall directly manage her affairs from now on, and bookings and inquiries may be directly addressed to her.”

Nakapaloob sa Article 1920, Chapter 4, Modes of Extinguishment of Agency na karapatan ng isang talent na umalis sa isang agency kung kailan nito gusto.

Sabi rito: “The principal may revoke the agency at will, and compel the agency to return the document evidencing the agency. Such revocation may be expressed or implied.” 

Sinampahan naman siya ng kaso ng Viva sa Regional Trial Court ng Quezon City noong December 2020 dahil sa pagwawalang-bahala ni Nadine sa exclusive contract na pinirmahan niya sa VAA.

June 2021, naglabas QC RTC ang resolusyon tungkol sa petisyon na inihain ng Viva Artists Agency Inc. laban sa kay Nadine.

Inutusan ng Quezon City RTC si Nadine na igalang at panindigan nito ang kanyang contractual obligations sa Viva.

Ipinatitigil din ng korte ang pagtanggap niya ng mga trabaho mula sa ibang kompanya bilang artist at endorser nang walang anumang pahintulot at partisipasyon ng Viva.

Sa kasalukuyan ay balik sa paggawa ng pelikula si Nadine sa Viva Films, ang Greed, kung saan katambal niya si Diego Loyzaga.
